Insurance arrangements for schools/ OSHCS and community coaches
Insurance is an important issue for community coaches, schools and Out of School Hours Care Services (sites) to carefully consider when making arrangements for delivery of activities within the Active After-school Communities (AASC) program.
Community coaches and sites are not covered by any Australian Sports Commission (ASC) insurance. Community coaches and sites must assess their respective insurance requirements in relation to the delivery of activities and must make their own insurance arrangements. The ASC does not arrange or pay for such insurance.
Community coaches (whether paid or volunteers) are not employees or contractors of the ASC. After registration with the ASC, coaches are engaged by the site, not the ASC, to deliver the relevant activities under the AASC program.
As part of the AASC community coach registration process, applicants are required to declare whether or not they carry Professional Indemnity insurance and/or Public Liability insurance and, if so, the amount of cover. This information is then made available to the sites by the ASC. The ASC does not check the existence, accuracy or adequacy of the insurance that an applicant coach claims to carry. Accordingly, the ASC makes no warranty to sites as to the existence, accuracy or adequacy of a community coach's claimed insurance.
Similarly, the ASC does not check the existence or adequacy of the insurance (if any) carried by sites that engage community coaches. Accordingly, the ASC makes no warranty to community coaches as to the existence or adequacy of the insurance (if any) carried by sites.
It is the responsibility of each community coach (whether paid or a volunteer) and sites engaging a coach to confirm the status of each other’s insurance position and to determine the adequacy of the insurance cover for their own purposes.
Questions to consider:
- What risks are covered by any relevant insurance policies?
- Who is insured under any relevant insurance policies? Does the site carry any insurance providing cover to community coaches? If so, does it only apply to volunteers and not paid community coaches?
- What is the extent of cover in dollar terms under any relevant insurance policy?
While the ASC may from time to time advise community coaches and sites of the existence of particular insurance products that may be available, the ASC does not, and will not, recommend any particular insurer or insurance product or advise on the suitability of any insurance product.
